Prisoner Granted Habeas Relief
A Sidley team, working with the Federal Public Defender’s Office for the District of Nevada, defeated a petition for certiorari to the U.S. Supreme Court in Gittere v. Echavarria, preserving a win in the Ninth Circuit and affording the client, Jose Echavarria, a new trial in lieu of a death sentence. A Nevada state court had convicted Mr. Echavarria of capital murder and sentenced him to death following a botched bank robbery in Las Vegas that resulted in the death of an FBI agent. The case addresses important questions about when judicial bias supports granting habeas relief.
