Sidley successfully represented an Egyptian woman who sought a divorce from her husband under California law. The client’s husband, in an effort to forestall her attempt to establish her rights to child custody, property and spousal support, had claimed that he had divorced her under Islamic law in 2013. The judge found that even if the divorce was valid under Islamic law, it could not be recognized under California law because the parties were not domiciled in Egypt at that time, and the principles of comity should not apply because the purported divorce was obtained ex parte and no Egyptian court had jurisdiction over the parties or the divorce.
